New Mexico will requirements (two witnesses who watched you sign)

You're going to die. The will you drafted the summer the swamp cooler quit is still a draft. The sunset over the Sandias is gorgeous, and it will not witness anything.

NMSA 1978 §45-2-502 is the ceremony this product walks. The will is in writing. You sign it, or someone signs your name in your conscious presence and by your direction. Then at least two people sign, and each of them signs in front of you and in front of each other, after each one watched the signing.

Watched. Not heard about. New Mexico gives no acknowledgment option, so a witness who shows up after the ink is dry is a guest, not a witness. And a handwritten will is not a shortcut here. The probate code says "Will" does not include a holographic will.

The short version

Witnesses At least two individuals, each of whom watched the signing (yours, or your proxy's) and then signed in your presence and in each other's (NMSA 1978 §45-2-502(C)). No acknowledgment alternative.

Self-proving Optional (§45-2-504), at signing or any time after. Affidavits or affirmations under penalty of perjury, before an oath officer, under official seal.
Holographic Not a will in New Mexico (§45-1-201(A)(57)). §45-2-503 reads "Reserved," so there is no harmless-error rescue in the statute text.

How to sign a will in New Mexico

Product path is §45-2-502 only. "Except as provided in Sections 45-2-506 and 45-2-513 NMSA 1978, a will must be: A. in writing; B. signed by the testator or in the testator's name by some other individual in the testator's conscious presence and by the testator's direction; and C. signed by at least two individuals, each of whom signed in the presence of the testator and of each other after each witnessed the signing of the will as described in Subsection B of this section."

  1. Put the will in writing.
  2. Sign it. Or have someone sign your name for you, in your conscious presence and by your direction.
  3. Both witnesses watch that signing happen. The statute's order is the point: each witness signs "after each witnessed the signing."
  4. Each witness signs in your presence and in the presence of the other witness.

The order matters more here than in most states. Some states let a witness arrive late and hear you say the signature is yours. New Mexico's text does not. Subsection C ties the witnesses to the signing described in Subsection B. Everyone in one room. You sign while they watch. Then they sign while you and each other watch. Nobody steps out to take a call. Section 45-2-506 is choice of law. A written will is also valid if its execution complies with the law of the place where it was signed, or of the place where you were domiciled, had a place of abode, or were a national, at signing or at death. That is a recognition rule for wills signed elsewhere. It is not a second ceremony for a kitchen table in Las Cruces. FAQ only. Section 45-2-513 lets a will refer to a signed list of tangible personal property, other than money. It is not a will. It is not a holographic will. Do not sign a list of who gets the turquoise and call the ceremony finished. Electronic and remote signing: out of scope. The probate code's definition of "sign" that includes an electronic symbol applies to "a record other than a will" (§45-1-201(A)(46)). Do not read it as permission to e-sign a will.

New Mexico will witnesses

At least two. Each one must have watched the signing, and each signs in your presence and the other witness's presence.

§45-2-505(A): an individual generally competent to be a witness may act as a witness to a will.

§45-2-505(B): "The signing of a will by an interested witness does not invalidate the will or any provision of it."

That is the whole interested-witness rule in the section. No gift forfeiture. No "two other witnesses" condition. No intestate-share cap. Vermont, Rhode Island, Kansas, and New Hampshire each have a witness-gift rule. New Mexico's section does not, and this page does not borrow one.

Still pick two people who take nothing. The statute will not punish a beneficiary-witness. Your relatives might, at Thanksgiving, for years.

Does a New Mexico will need to be notarized

For validity under §45-2-502: no.

Self-proving is optional, and New Mexico gives you two timings.

§45-2-504 A: the will may be signed, witnessed, and made self-proved at the same sitting. You acknowledge the will. The witnesses make "affidavits or affirmations under penalty of perjury." Each is made before an officer authorized to administer oaths under the laws of the state where the signing happens, and the officer's certificate goes under official seal.

§45-2-504 B: an attested will may be made self-proved any time after it was signed, the same way, with the certificate attached or annexed to the will.

§45-2-504 C: a signature on a self-proving affidavit attached to the will counts as a signature on the will if that is needed to prove due execution.

Affirmation is a real option. The statute and its forms say "swear or affirm." If swearing an oath is not your thing, the form already accounts for that.

The statutory testator form has you say that "the will was read by me (or read and explained to me) after being prepared and before I sign it." That line lives in the affidavit form. It is not a fourth element of §45-2-502. A will is not invalid under §45-2-502 because nobody read it aloud. Read it anyway. It is your will. Typos in a will are a gift to the people who want to argue about it.

Self-proof does not replace the two witnesses. They still watch, and they still sign.

New Mexico will mistakes that hurt later

  1. Treating acknowledgment as a substitute for watching. §45-2-502(C) has each witness sign "after each witnessed the signing of the will." There is no "or acknowledged" clause. A witness who hears about the signature afterward did not witness the signing.
  2. Dropping "each other." Each witness signs in your presence and in the other witness's presence. Two witnesses signing on two different afternoons does not match the text.
  3. Counting on a handwritten will. "Will" does not include a holographic will (§45-1-201(A)(57)). A handwritten New Mexico will still needs the full §45-2-502 ceremony.
  4. Counting on a harmless-error rescue. §45-2-503 reads "Reserved." New Mexico's statute text has no section that treats a botched ceremony as good enough.
  5. Reading the electronic "sign" definition as an e-will. §45-1-201(A)(46) applies to "a record other than a will."
  6. Teaching the self-prove form's "read and explained" line as a validity rule. It is form language for the optional affidavit.

Are holographic wills valid in New Mexico

No. New Mexico's probate code defines "will," and the definition ends with this sentence: "'Will' does not include a holographic will." (§45-1-201(A)(57)). Section 45-2-502 has no handwritten subsection. Section 45-2-503 reads "Reserved." The compiler's note says the uniform model's 2-503 is a harmless-error provision. New Mexico left the slot empty.

So a will in your handwriting is fine as long as it goes through §45-2-502: two witnesses who watched you sign, signing in front of you and each other. Handwriting alone does nothing. Do not borrow a handwritten-will yes from South Dakota, Utah, Idaho, Nebraska, Kentucky, or West Virginia. They are not here.
